Eaglefield expansion project
The proponent for the Eaglefield Expansion Project (EEP) is Peabody Energy Australia Coal Pty Ltd. (Peabody), a wholly owned subsidiary of Peabody Pacific Pty Ltd. The EIS process was initiated by Peabody on 16 September 2008 by application to the department for approval to prepare a voluntary EIS under Section 70 of the EP Act. The department approved the application on 19 September 2008.
The status of the process for the assessment of the EEP is as follows:

- Public notification of draft TOR
- Final TOR issued—EIS in preparation
- Public notification of EIS
- Proponent responds to submissions
- EIS assessment report
The EIS assessment report was issued to the proponent on 7 October 2011 and the EIS process under Chapter 3, Part 1 of the EP Act has now been completed.
The project was determined to be a controlled action under the Commonwealth Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The controlling provisions related to listed threatened species and communities. The EIS assessment report contains an assessment of the significance of impacts of the action on the controlling provisions. A copy of the EIS assessment report has been given to the Commonwealth Environment Minister, who will decide whether to approve or refuse the controlled action under Part 9 of the EPBC Act.
