Privacy information

Personal information collected for the Resilient Homes Fund will be handled as detailed below. Persons are required to agree to these conditions in participating in the Fund, including registering interest in the Fund.

The following definitions apply:

  • Government agency means an Australian or Queensland State or Local government agency, authority or instrumentality, including but not limited to the Department of Housing and Public Works, the Queensland Reconstruction Authority and the Queensland Rural and Industry Development Authority
  • Fund means the Resilient Homes Fund
  • Relevant Person means:
    • a government agency
    • a relevant NGO
    • the insurer identified by you or as updated by you from time to time and
    • any licensed contractor identified by you from time to time.
  • Relevant NGO means any non-government organisation administering or involved in any programs, grant arrangements or human and social support services associated with the 2021-22 rainfall and flooding events and relief efforts
  • We or us means the State of Queensland, acting through the Department of Housing and Public Works. and its authorised representatives
  • You means a person who participates in the Fund, including a person who registers interest in the Fund and/or makes an application under a program under the Fund.

Third party consents

In participating in the Fund:

  1. You authorise relevant persons to disclose to us such information (including personal information) from the relevant person as we consider to be necessary or appropriate;
    • in connection with your registration of interest in or any aspect of the Fund, including information to support or in connection with your eligibility for the Fund, and in relation to the administration and management of the Fund and any funding provided to you, or a delivery partner authorised by us, under the Fund, and/or
    • in connection with any other grant, program or service provided by us, other government agencies or relevant NGOs which are associated with the 2021-22 rainfall and flooding events and relief efforts.

    (that information being referred to as Third Party Information).

  2. You warrant that you will, if requested by us or a relevant person contacted by us, provide the relevant person with consent to speak to and share third party Information with us. If you have identified an insurer, you acknowledge that the third party Information includes information about any claim you may have made relevant to the flood events, the status of the claim, and any assessment the insurer may have undertaken on your home and the damage it sustained.

Information collection notice

We are collecting and obtaining (from you and from the relevant persons) your personal information in connection with your participation in (including any registration of interest or application made under) the Fund, for the following purposes.

We and the Relevant Persons may also use your personal information for the following purposes:

  • assessment of your eligibility to receive funding under the Fund
  • the administration and management of the Fund including for compliance and enforcement purposes
  • the purposes set out in paragraph (b) below; and
  • any other purposes related, or otherwise necessary to give effect, to the purposes listed above
  • to contact you in relation to your registration of interest, any future application under the Fund, and the administration of the Fund
  • to facilitate internal business operations and fulfil legal obligations
  • research, policy and planning functions to evaluate the outcome of the Fund, for example, requesting the completion of feedback surveys and contacting you to seek further information to assist in the process
  • to promote or market Our and other Government Agency or Relevant NGO grants, programs and services (including assessing the success and outcomes of the grants, programs and services)
  • to identify and assess, or enable the identification and assessment of your eligibility for or interest in other government agency or relevant NGO administered grants, programs or services; and
  • to assess the performance of our and other government agency or relevant NGO grants, programs or services.

Disclosure of your personal information

We may disclose your personal information to:

  • the Relevant Persons and
  • our agents and contractors

to the extent necessary or convenient to enable us to further the purposes described in the Information Collection Notice (which do not extend to commercial purposes).

We will comply with the Human Rights Act 2019 (Qld) when making any decision, including with respect to collection, use, and disclosure of personal information.

Terms of participation

In participating in the Resilient Homes Fund (‘Fund’), including registering Your interest in the Fund:

  • You certify that, to the best of your knowledge and belief, all information provided in your registration of interest is true and accurate and discloses the current status of any insurance claim, the damage to your home, and any steps already taken to remediate the damage.
  • You certify that to the extent any information provided in relation to your registration of interest contains information of, or about, another person, you have the authorisation of that person to provide the information and for it to be used and disclosed in accordance with the authorisations set out in the registration of interest (and found under Privacy information on this page).
  • You understand that your registration of interest form is not a formal application under the Fund, and you will need to make a formal application in the future depending on your eligibility and the contents of any Home Assessment Report.
  • You understand that you are participating in this registration process and the Fund at your own risk and may not be entitled to any funding under the Fund. You further acknowledge that you will not have any claim of any kind whatsoever against us (whether in contract, tort (including negligence), equity, under statute or otherwise) arising from or in connection with any costs, expenses, losses or liabilities suffered or incurred by you in connection with the Fund.
  • You understand that any decisions you make about insurance matters and/or progressing or delaying work on your home are decisions for you to be made at your own cost and risk. You understand that we cannot provide guarantees about whether you will be successful in obtaining funding through the Fund, or if so, when that funding will be available.
  • You acknowledge and accept that we retain all rights and powers to make all decisions and actions in order to achieve the Fund objectives and we reserve the right, in our absolute discretion and at any time, to change the structure, procedures, nature, scope or timing of, or alter the terms of participation in the process or overall Fund.

In these Terms of Participation:

  • We or us means the State of Queensland, acting through the Department of Housing and Public Works and its authorised representatives.
  • You means a person who participates in the Fund, including a person who registers interest in the Fund and/or makes an application under a program under the Fund.

Note: These Terms of Participation are the terms which you are required to agree to as part of registering your interest in the Fund.
