Residents’ committees
The residents’ committee works with the operator in the day-to-day running of the village and common matters, and present residents’ complaints and proposals to the operator.
Committees can also:
- contribute to village processes
- request a document that explains the expenditure involved in providing each general service and any variation from the amount originally budgeted
- request quarterly financial information about the capital replacement fund, maintenance reserve fund and the general services charges fund
- request a copy of a draft budget for the capital replacement fund, maintenance reserve fund or general services fund and the corresponding quantity surveyors reports.
By law, residents may establish a residents’ committee by an election of the residents. Residents elect the committee and can remove a member by passing a special resolution of a meeting of village residents. A committee member holds office for only 1 year but can be re-elected.
The residents' committee determines its own procedures and can form subcommittees. If a majority of residents vote on it, the committee can adopt a constitution and, from then on, must conform to the constitution.
Committee meeting minutes
The committee must take accurate minutes of each meeting including:
- the meeting’s date, time and place
- each attendees name and, if relevant, the capacity in which they attend
- the meeting’s issues and how they were addressed
- any tabled correspondence, reports, notices or other documents.
The committee presents the minutes at the following meeting, and, if confirmed, a member signs the minutes as accurate. Then, if they request, the committee gives residents access to, or a copy of, the minutes.
The committee must keep a record of the meeting minutes for the retirement village.
Operator attendance
Operators can attend or speak at residents' committee meetings only when invited or voting on a special resolution.
If an operator attends a meeting, they must leave it after they have spoken to the members unless they are invited to stay.
The committee might invite them to attend a meeting before the start of the financial year to discuss the draft budget for the:
- capital replacement fund
- maintenance reserve fund
- general services charges fund.
If the committee gives an operator the required 28 days’ notice of the meeting, they must attend.
