The new Duties of Justices of the Peace (Qualified) and Commissioners for Declarations handbook is one comprehensive handbook for both:

  • Justices of the Peace (JPs)
  • Commissioners for Declarations (Cdecs).

The combined handbook clearly explains what is expected of you as a JP or Cdec. You can use it as a day-to-day reference to help you perform your duties correctly and consistently.

The new handbook combines the previous handbooks:

  • Duties of Justices of the Peace (Qualified)
  • Duties of Commissioners for Declarations.

Logbook

The logbook template helps JPs and Cdecs keep the required records.

Use this template to record your witnessing activities. It also includes general witnessing steps and a list of oaths and affirmations.

Record of Titles Registry forms

You must keep a record of Titles Registry forms you have witnessed—this is a mandatory requirement of the Land Title Act 1994 (the Act).

To help you fulfil your obligations under section 162 of the Act, we have developed the Record of Titles Registry forms template. It will help you record the correct information for each Titles Registry form.

Why we combined the handbooks

JPs and Cdecs share the same administrative role when witnessing most documents.

Sections 1 to 4 of the combined handbook now apply to both JPs and Cdecs. Sections 5 and 6 only apply to JPs. Cdecs will be able to clearly see where their administrative role ends and where the judicial function of JPs begins.

Section tabs no longer available

To keep costs down, section tabs are no longer available. This means we can keep the cost of the combined handbook the same as the previous version.

Sample forms moved online

Forms are updated more often than legislation. In previous handbooks, sample forms often became outdated.

We have removed the sample forms from the handbook and published them online. This means you will only need to update your new combined handbook when legislation changes affect your witnessing role.
