Apply to be an animal valuer
Under the Criminal Code Act 1899, a person may be appointed as an animal valuer to determine the value of stock involved in a stock offence.
You can apply to be appointed as an animal valuer under the Criminal Code (Animal Valuers) Regulation 2014.
Eligibility
You can apply to be an animal valuer for stock offences if you are an adult and both:
- have not been convicted of an indictable offence or an offence involving dishonesty
- are not bankrupt or have not benefited from bankruptcy laws in the past.
Suitability for appointment as an animal valuer will depend on your ability to perform the duties of an animal valuer, including your skills, qualifications and experience in valuing livestock.
Qualifications and experience
Your qualifications may include other licences held, such as:
- a chattel auctioneer licence under the Motor Dealers and Chattel Auctioneers Act 2014
- any tertiary qualification relating to livestock.
Experience and work history may include moving, selling or identifying livestock on a regular basis.
Duties of an animal valuer
An animal valuer may be required to:
- attend a specified place at a specified reasonable time
- carry out a valuation of an animal
- complete and sign a certificate of valuation for the animal’s value and immediately send it to the prosecutor for the proceeding and a copy to the chief executive
- attend a proceeding relating to the valuation, or appear as a witness for the prosecution in the proceeding, unless there are special or unusual circumstances preventing the animal valuer from doing so.
Pay for an animal valuer
If you are asked to do a valuation, the total fee payable for each day or part of a day that involves valuations is $221.60.
If you need to travel and incur travelling expenses, you may be reimbursed the travel expenses if they are reasonable.
You may also be entitled to claim meal allowances in certain circumstances.
How to apply
To apply to become an animal valuer you need to complete and return the application form by post or email.
How your application is assessed
We will consider each application and may make enquiries for further information. We will contact you if we need more information.
If appointed
If we appoint you as an animal valuer, your details are placed on our animal valuer register and we may contact you with details to do a valuation.
Your appointment details remain on this register until your appointment is terminated.
Conflict of interest
If we contact you to complete a valuation and you become aware of an actual or potential conflict of interest with the criminal proceeding, you must immediately advise us and the prosecutor for the proceeding.
An actual conflict of interest is where you have an interest, financial or otherwise, that conflicts with the proper performance of the functions of an animal valuer for the proceeding.
A potential conflict of interest is where you have an interest, financial or otherwise, that could conflict with the proper performance of the functions of an animal valuer for the proceeding.
This does not mean that your appointment as an animal valuer will be terminated. However, we will attempt to find another animal valuer for those particular proceedings.
Termination of appointment
As part of your appointment conditions, you must notify us as soon as possible if any of the following events occur or apply:
- you change your name or address (within 28 days)
- you are convicted of an indictable offence or an offence involving dishonesty
- you become bankrupt or take advantage of the laws about bankruptcy.
Your appointment may be terminated if:
- you are convicted of an indictable offence or an offence involving dishonesty
- you become bankrupt or take advantage of the laws about bankruptcy
- we consider that you are no longer suitable
- you have not complied with the Criminal Code (Animal Valuers) Regulation 2014
- you resign by signed notice to the chief executive.
It is an offence under the Criminal Code (Animal Valuers) Regulation 2014 to provide false or misleading information, including information in a document (such as an application form) that you know is false or misleading. The maximum penalty for this offence is 100 penalty units.
Locations
Generally, animal valuations are held at police stock squad locations.
However, you do not need to live in these areas to apply. If you are willing to travel, you may express your interest in other areas and may be reimbursed for your travel costs according to our travel reimbursement policy.
