myQld terms and conditions

Definitions

For the purposes of these Terms, the following definitions apply.

Customised means content, experience or functionality that requires active involvement from you, such as logging in or completing an activity or process online. This is based on your needs or interests and allows you to make changes to configurations such as layout, content or functionality as desired.

Form means a digital form made available through myQld for you to access and transact with Queensland Government services.

Queensland Government body means any of these:

  • a body corporate or an unincorporated body established or constituted for a public purpose by the State of Queensland legislation, or an instrument made under that legislation (including a local authority)
  • a body established by the State of Queensland through the Governor or a Minister
  • an incorporated or unincorporated body over which the State of Queensland exercises control.

myQld means a whole-of-Queensland-Government digital service delivery platform hosted by the Queensland Government through the Queensland Government Customer Digital Group within the Department of Customer Services, Open Data, Small and Family Business.

myQld includes:

  • myQld Customer Services Platform—a whole-of-government platform able to be used by Queensland Government agencies to deliver digital services to you
  • myQld Services Portal (the Portal)—a whole-of-government portal providing you a single, secure place to access, view and manage your digital interactions with the Queensland Government.

Personalised means the content, experience or functionality for you using data from systems such as search, social media and analytics. This information ranges from personal information, location, keywords and tags, device visitor frequency, date, time and weather, session behaviour and so on. By remembering information about you, we can deliver or emphasise particular information and simplify transactions and processes even when you do not know exactly what you need and need to filter through a large information space.

Service means any deliverable that is provided by the government of Queensland, Australia to its residents, businesses, and visitors. These services are developed, owned and managed by various government departments and agencies using myQld.

Service owner means the relevant Queensland Government department, agency or  body which may provide information or services to you upon receipt and approval of an appropriately completed and submitted form.

Terms means these terms and conditions of use for myQld.

We and Us means the State of Queensland acting through the Department of Customer Services, Open Data and Small and Family Business.

You/User means the individual accessing and using myQld.

Terms and conditions of use

These Terms describe your rights and responsibilities as a user of myQld. Your use of myQld is subject to these Terms. By using myQld, you are agreeing to all of the Terms. You should carefully read these Terms before using myQld.

Variations

We reserve the right to amend these Terms and the myQld products at any time. Your continued use of myQld constitutes your acceptance of any amendments to the Terms.

Termination of access

We may terminate your access to myQld at any time and for any reason, including where we believe you may have breached these Terms. We will have no liability to you for any losses, damages or costs of any kind you incur as a consequence of us terminating your access to myQld.

myQld

We retain the right to modify or discontinue myQld at our discretion. myQld is made available to you without assurances of continuous, error-free access.

Your use of myQld does not change or lessen:

  • the commitment of any service owner to provide services to you
  • your obligations to any service owner related to the services received from them.

If myQld is not available to you, alternative access by the service owner may be provided through their website or other service delivery channel. You can contact the service owner in writing, online, by telephone or in person.

By beginning a form delivered through myQld, an account on the Portal will automatically be created for you using your selected identity through your digital identity provider. This account will enable you to save a draft of your form so that you can resume, review and complete it later as well as view the submitted application later.

Your saved draft will be available for 14 days from the last time you updated it. After that time, it will expire and be deleted from myQld.
The personal details able to be saved to myQld are title, preferred name, contact email, mobile number, home address and postal address. Your submitted digital services will be kept by myQld for 30 days. Within this period, the agency responsible for the digital service will be able to retrieve your submission to process it. Your personal information will be handled by the agency according to its privacy statement which you can access via the digital service.

After 30 days, key summary details of your submitted service will be kept and stored as service tracking details by myQld. Your remaining data submitted for that service will be deleted. The key summary details will enable you to identify the digital service within the Portal and you will be able to see its latest status (e.g. submitted, completed). The key summary details are determined by the agency which provides the service and no Personally Identifiable Information (PII) will be included.

myQld will keep a contact email so that we can contact you about changes to services and notify you when changes have been made to your profile details, as a security check. Unless you provide an alternate contact email, we will use the digital identity email that you use to log in via the Queensland Government Digital ID Exchange to contact you.

When making changes to your personal details via the Portal, some extra security features exist. You will be asked to verify changes made to your contact email address and you will receive an email to do this. Similarly, when you update your mobile number, you will receive a SMS to verify the update.

myQld will also send you an email notification each time a change is made to your personal details as a security check to ensure that they were made by you. Within the Portal, you will be able to see an activity log of changes that you have made.

To update details for any submitted agency digital services, you will need to contact the agency.

Your obligations

Your access to myQld is provided on the condition that you do not misuse the products or services provided through it.

In accessing and using myQld, you must not:

  • commit or encourage any unlawful offences
  • transmit or distribute any harmful computer program or virus
  • hack into any part of the services
  • include any threatening, inflammatory, offensive, obscene, scandalous, inappropriate or discriminatory content within the forms
  • provide any false or inaccurate information
  • access and use the services for any dishonest, fraudulent, misleading or malicious purposes
  • infringe upon any other person’s proprietary rights
  • attempt to affect the operation, performance or functionality of myQld.

If you breach any of these prohibitions and we reasonably believe that such breach may constitute a criminal offence, we will report the breach to the relevant law enforcement authorities and disclose your identity to them.

Providing information

By submitting any information through your use of myQld, interacting with services, or when providing supplementary information or documents, you affirm and guarantee that:

  • you have the right to supply the information
  • the information you provide is truthful, precise, current, complete, and is in no way deceptive
  • in instances where you supply document copies, you are authorised to provide an unrestricted, everlasting, non-exclusive, global, irrevocable licence, free of royalty fees, for us to use, copy, and exploit the intellectual property rights within the documents for any purpose.

Intellectual property rights

The copyright and other intellectual property rights in myQld, including all content made available to you through myQld, is owned or licensed by us.

You may copy, store, print and distribute the content supplied solely for your own personal use.

Service owner’s additional terms and conditions

The service owner may, in their absolute discretion, impose additional terms and conditions of use related to your transaction with a service.

The service owner’s additional terms and conditions of use take precedence over these terms where they relate to the service owner providing you with services.

Exclusion of warranties

Your use of myQld is at your own risk. We make no statements, representations or warranties about the quality, suitability, accuracy, completeness, currency, availability or reliability of myQld or any information or content you may be provided through your use of myQld.

To the maximum extent permitted by law, we expressly exclude all warranties and other terms which might otherwise be implied by legislation or common law and will not be liable for any damages, including indirect and consequential loss, arising out of or related to the use, inability to use, performance or failures of myQld.

Exclusion of liability

To the maximum extent permitted by law, we expressly exclude all responsibility and liability (including liability for negligence) for any loss or damage you may suffer or incur as a direct or indirect result of your use of myQld or the information contained within myQld, including any loss or damage arising from:

  • the information being inaccurate, incomplete or out of date
  • the information or any myQld product being subject to infection by any harmful computer program or virus
  • any lack of availability or interruption in the operation of myQld
  • any failure by myQld to complete certain actions undertaken by you, e.g. any failure by myQld to successfully
    • save partially completed forms for retrieval by you at a later time, or
    • submit any completed forms to the relevant service owner.

We accept no responsibility in respect of the services, if any, provided to you by the service owner.

Indemnity

You agree to fully release, discharge and indemnify us from and against any loss, damage, liability, cost or expense (including legal expenses) suffered or incurred by us, arising from your use of myQld or your breach of these terms.

Severability

If any part of these terms is invalid, unlawful or unenforceable, the invalid, unlawful or unenforceable part of these terms will not apply, but the other parts of these Terms will not be affected.

Jurisdiction

These Terms will be governed by and are to be construed in accordance with the laws of the State of Queensland and you agree to submit to the exclusive jurisdiction of the courts of Queensland.

Privacy

Our privacy notice sets out how we will collect, use and handle your information as a result of your use of myQld.

By using myQld, you consent to the collection, use and handling, including disclosure, of your information as described in the privacy statement.
