Use this form to apply to renew a lease for land under the Land Act 1994.
At least 80% of the term of your lease must be completed to apply for a renewal. Under special circumstances, we may consider early applications. Read our policy on renewing a lease (PDF, 214KB) to see if you meet the criteria for an early application.
You can’t use this form to extend a rolling term lease. If you have a rolling term lease, you should apply to extend the lease instead of renewing it.
Road licences, occupation licences and permits to occupy can’t be renewed.

we’ve issued you a notice to say we’ve already started looking into your lease to see if a new lease is the most appropriate tenure for the land. The notice will either:
give you the opportunity to provide feedback before we finalise the decision
state that we’ve decided not to offer you a new lease because a lease isn’t the most appropriate tenure for the land
request you apply for a new lease so that we can process your lease renewal.
Term lease renewals can only be granted:
to the same lessee as the current lease
for the same purpose as the current lease.
If the state wants to secure a portion of your leased land for public use (for example, a road or a reserve for community purposes), we may offer you a renewed lease for a smaller area than your current lease.

You, or a legal practitioner on your behalf, must electronically sign the application. It will then automatically be lodged through the online process.

You can pay your application fee:
via credit card over the phone. Departmental officer will contact you to organise the payment
via cheque by post. Cheques should be made out to the 'Department of Resources' and marked 'not negotiable'.
We'll send you a receipt once we've established that your application meets all requirements.
We’ll assess your application against legislative requirements. We’ll seek the views of other stakeholders (e.g. state, regional and local agencies) and inspect the land if required.
We’ll also ensure all outstanding rent on the lease has been paid.
Our review will also include an assessment of whether native title issues need to be addressed, and how this should be done. Depending on the outcome, you may be required to address native titles issues as a condition of the offer.
Converting land to freehold
Under sections 159 and 159A of the Land Act 1994, we may assess the lease and decide that the land should be freehold. In this case, we will treat your renewal application as a conversion application and send you an offer to convert the land to freehold, and you’ll have an opportunity to purchase.
Once we have received the advice of other stakeholders and all issues have been investigated, we will send you a written notice of the decision. Your application may be:
approved
approved over a reduced area (approved in part)
refused.
If your application is successful, a written offer will set out the various conditions and requirements. You must complete the acceptance form and return it to us by the date specified or the offer will lapse.
The conditions may include:
the new terms and conditions of the renewed lease
if only part of the lease is being renewed, provide written consent to the conditional surrender of the existing lease from any registered lender for the mortgage or holder of a sublease
lodge a plan of survey, if needed
pay all regulatory fees and charges.
Once you’ve accepted the offer and satisfied all conditions, the existing lease will be surrendered the day before the date the new lease commences. The Governor in Council or the Minister for Resources grants the new tenure.
The new lease will be subject to the same relevant encumbrances as the previous lease, in the same priority order.
Information on this form, and any attachments, is being collected to process and assess your application under section 158 of the Land Act 1994. The consideration of your application may involve consultation, and if so details of your application may be disclosed to third parties. They will not be otherwise disclosed outside the department unless required or authorised by law.
We may wish to contact you to seek your views on our service, to advise you of any legislative changes that might affect you, or to seek your participation in surveys or programs relevant to your application type. Any participation will be voluntary and you can email stateland@resources.qld.gov.au if you don't want the department to contact you.
We may also compile or analyse statistics and conduct research. Any findings we publish won't include identifying personal information.
Under the Right to Information Act 2009, interested parties may seek access to our records and view relevant documents.
If your application is refused solely on the basis that you have not fulfilled the lease conditions, you can appeal against the decision.
